Recovery Fee Agreement
Draft for counsel review (2026-10-25: cap removed). Not yet in force. Counsel should check state rules on contingency-fee and "debt adjusting" or "credit services" arrangements, whether an uncapped percentage on large recoveries needs any state-specific limit or disclosure, and whether any state bars fees on government benefits, tax refunds, unclaimed property or class settlement payments. Until this is reviewed, Ombudly should not charge recovery fees.
This agreement is between you and [Legal entity] and is part of the Terms of Service. It applies only if your plan has a recovery fee.
1. When a fee applies
A recovery fee applies only when all of these are true:
- Ombudly's advocate made the request that led to the money (a refund, credit, price adjustment, fee reversal, waived charge or reimbursement);
- the request was sent within your permission settings or approved by you; and
- Ombudly verified that the money arrived: we matched it to a deposit or credit in an account you connected, or you confirmed it.
No fee applies to money you recovered on your own, money that would have arrived anyway (for example a refund already in progress before our request), government benefits, tax refunds, unclaimed property (state law limits finder fees), class-action or FTC settlement payments, or anything you were told about but filed yourself.
2. How much
| Plan | Rate |
|---|---|
| Watchdog (free) | 20% |
| Advocate | 10% |
| Intensive | 10% |
The fee is the rate times the amount recovered. There is no cap: if we recover $100,000 for you on a paid plan, the fee is $10,000. You see the amount, with the evidence, before it's billed (section 3). Credits and avoided charges (for example a waived fee that was never charged) count at their dollar value. [Counsel/decision: whether avoided future charges such as a lowered bill count, and for how many months.]
3. Before you're charged
You'll see each fee in the app with the evidence: what we asked for, when, what arrived, and where. You'll have [14] days to dispute it before it's billed. If a recovery is reversed (for example a chargeback is undone), we'll refund the fee.
4. Billing
Fees are billed to your payment method on file through Stripe [monthly in arrears]. If you don't have a payment method, we'll ask you to add one; [we won't withhold or deduct from your money, and we never take money from your bank accounts directly].
5. Ending this agreement
You can switch to a plan without recovery fees, or close your account, at any time. Fees for recoveries verified before you leave remain due; requests still pending when you leave don't create a fee.
