Terms of Service
Draft for counsel review (2026-10-21). Not yet in force. Bracketed items need a decision. This draft was prepared from how the product actually works; it is not legal advice.
These terms are an agreement between you and [Legal entity, e.g. "Datastreams Solutions LLC, doing business as Ombudly"] ("Ombudly", "we", "us") for the Ombudly website, web app, mobile apps, API and MCP server (the "Service"). By creating an account or using the Service you agree to these terms and to the Privacy Policy. If you don't agree, don't use the Service.
1. What Ombudly does
Ombudly is software that acts as a financial advocate on your behalf. With the access you grant, an AI agent reviews your financial records (bank and card transactions, documents and emails you connect), finds money you may be owed or overcharged, prepares and sends requests to companies, follows up, and checks whether money arrived. It can also show you budgeting views, benefits you may qualify for, tax information, settlement programs and investment account information.
Ombudly is not a law firm, a licensed tax preparer, a CPA, an enrolled agent, a registered investment adviser, a broker-dealer, a credit repair organization, a debt settlement company or a bank. Nothing in the Service is legal, tax, investment or financial advice. Results are not guaranteed: companies decide whether to pay.
2. Eligibility and your account
You must be at least 18, able to form a binding contract, and a resident of the United States [and any other supported country]. You're responsible for your account, for keeping your sign-in secure (we require multi-factor authentication for consequential approvals), and for everything done through it, including by agents you connect with an agent token. Tell us at [security@ombudly.com] if you suspect unauthorized access.
3. Authorizing the advocate
When you use the Service you authorize Ombudly to act as your agent, within the permission mode you choose, to:
- read the accounts, documents and emails you connect;
- prepare messages, forms, disputes, complaints and claims about your own accounts and purchases;
- send requests to companies (by their websites, chat or email) where your permission mode allows it without your approval; and
- sign in to sites with credentials you saved in the vault, when your settings allow it.
Actions that commit you, attest to facts, share sensitive information or move money always require your explicit approval: cancelling or changing a service, accepting an offer or terms, signing or swearing to anything (including claims and tax returns), sharing account numbers or health information with a third party, and any payment. You can approve, edit or decline each one. You can change your permission mode, revoke agent tokens, disconnect accounts or pause the advocate at any time.
You confirm that the information you give us (for example household size or income) is true, and that you're authorized to act on every account you connect. You're responsible for reviewing anything you approve.
4. Third-party services
The Service connects to third parties you choose or that we use to provide it, including Plaid (bank connections), email providers (by IMAP), companies' websites, cloud browsers, AI model providers and payment processors. Their terms and privacy policies also apply to your use of them. By connecting a bank account you also agree to Plaid's End User Privacy Policy. We aren't responsible for third parties' services or for what companies decide.
5. Fees
Plans and prices are listed at /pricing. Paid plans renew monthly until cancelled; you can cancel anytime and keep access until the end of the period. Recovery fees apply only under the separate Recovery Fee Agreement, only on money we verify arrived because of a request we made, and never above the cap shown. Taxes may apply. [Refund policy for plan fees: decide.]
6. Tax filing help and investments
Guided tax filing is governed by the Tax Filing Help Terms. Investment information is governed by the Investments Notice. Using an agent with our API or MCP server is governed by the Agent and API Terms.
7. Acceptable use
Don't use the Service to: act on accounts you aren't authorized to act on; make false statements to companies, courts or agencies; file claims you aren't eligible for; harass anyone; break the law or any company's terms in ways that harm others; probe, scrape or overload the Service; reverse engineer it except where the law allows; or resell it without our written consent.
8. Electronic communications
You agree to receive communications (including notices, approvals and receipts) electronically in the app, by push notification or by email, and that these satisfy any requirement that communications be in writing. You can withdraw this consent by closing your account.
9. Your content and data
You own your data. You give us a license to use it only to provide, secure and improve the Service as described in the Privacy Policy. We don't sell your personal information, and we don't let AI model providers train on it [subject to each provider's API terms, listed in the subprocessor list]. You can export or delete your data at any time from Settings.
10. AI disclosure
The advocate uses AI models. AI can make mistakes: it may misread a document, miss an opportunity or draft an imperfect message. That's why consequential steps need your approval and why we show the evidence behind each action. Review what you approve.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any recovery, refund, benefit, tax outcome or investment result.
12. Limitation of liability
To the fullest extent the law allows, Ombudly isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim and $100. Some jurisdictions don't allow these limits, so they may not apply to you.
13. Indemnity
You'll indemnify Ombudly against third-party claims arising from information you provided that was false, actions you approved that broke the law or someone else's rights, or your breach of these terms.
14. Disputes
[Counsel to choose: informal resolution period; binding individual arbitration under the AAA Consumer Rules with a class-action waiver and small-claims carve-out and 30-day opt-out; or courts of [State].] These terms are governed by the laws of [State], without regard to conflict-of-laws rules.
15. Termination
You can close your account anytime in Settings. We may suspend or close accounts that break these terms or put others at risk, with notice where practical. Sections that by their nature should survive termination (fees owed, disclaimers, limits of liability, indemnity, disputes) survive.
16. Changes
We'll notify you of material changes at least 30 days before they take effect, by email or in the app. Continuing to use the Service after that means you accept the new terms.
