Tax Filing Help Terms

Draft for counsel review. The app shows these terms (version tax-filing-terms-2026-10-18-draft) and records your acceptance before guided filing. Counsel should confirm that guided form-filling on IRS Free File or Free File Fillable Forms, where the user signs and submits, doesn't make Ombudly a "tax return preparer" (IRC §7701(a)(36)) or require a PTIN, and check state rules.

These terms apply when you ask Ombudly to estimate your federal return or help you fill it in on an IRS portal. They add to the Terms of Service.

1. What we are and aren't

Ombudly is not a tax preparer, CPA, enrolled agent or attorney, and doesn't give tax advice. The estimate is arithmetic on your records and the facts you gave us, using published IRS figures for the tax year.

2. You file, not us

Ombudly doesn't sign your return as a preparer or file it for you. You sign in to the IRS portal yourself (IRS Free File guided software, or Free File Fillable Forms), review every number, and sign and submit the return yourself.

3. Your responsibility

You're responsible for your return being complete and correct. Mistakes can mean penalties and interest. The estimate can be wrong, and any refund isn't guaranteed.

4. What the advocate does

The advocate only fills in forms on the portal you choose, from your own records, and stops before signing. Signing, attesting and submitting always need your explicit approval in Ombudly and your own action on the portal. You can take over at any point.

5. Limits

Ombudly's liability for anything related to this help is limited to what you paid Ombudly in the last 12 months. The estimate covers common situations only (wages, interest, standard deduction, child and earned income credits). For anything else, or if you're unsure, use IRS VITA (free) or a paid preparer.
